Objective

The objective of this Zakah Policy document is to outline how Progressive Welfare Foundation (PWF) views and deploys Zakah donations received from individuals and businesses.

Zakah Recipients

Zakah can only be given to individuals, or their agents, that belong to one of the eight categories mentioned in Surah At-Taubah 9:60.

اِنَّمَا الصَّدَقٰتُ لِلۡفُقَرَآءِ وَالۡمَسٰكِيۡنِ وَالۡعٰمِلِيۡنَ عَلَيۡهَا وَالۡمُؤَلَّـفَةِ قُلُوۡبُهُمۡ وَفِى الرِّقَابِ وَالۡغٰرِمِيۡنَ وَفِىۡ سَبِيۡلِ اللّٰهِ وَابۡنِ السَّبِيۡلِ​ؕ فَرِيۡضَةً مِّنَ اللّٰهِ​ؕ وَاللّٰهُ عَلِيۡمٌ حَكِيۡمٌ‏ 

 

[9:60] The alms are meant only for the poor61 and the needy62 and those who are in charge thereof,63 those whose hearts are to be reconciled,64 and to free those in bondage,65 and to help those burdened with debt,66 and for expenditure in the Way of Allah67 and for the wayfarer.68 This is an obligation from Allah. Allah is All-Knowing, All-Wise.

The eight categories are

1.       The poor: Those who have nothing

2.       The needy: Those that do not have enough for their needs (e.g. they don’t have enough food or clothes or money for education etc.)

3.       The Zakah-administrator: Those who collect and administer the Zakah (usually centrally)

4.       Those whose hearts are to be reconciled: New Muslims and friends of the Muslim community

5.       Slaves: Those held captive including modern day slavery

6.       Those in debt: Those who have debts greater than their assets

7.       Fi-sabeelillah: Those in the cause of Allah swt

8.       The traveler: Those who whilst away from home are cut-off from their resources

Our view

PWF considers itself (or not) to be a recipient of Zakah under category 3 (Zakah-administrator). However, it will not accept more than ⅛ of Zakah collected for its own purposes.

Zakah Officer

PWF will nominate a designated person named as the Zakah Officer. The scope and responsibilities of the Zakah Officer is outlined in a separate Zakah Officer Role Description document.

Shariah Advisor

PWF will appoint annually, and normally for a minimum of three years, a shariah advisor to review and audit it’s Zakah policy, procedures and practices. Details of the scope of such engagement will be outlined in a separate Shariah Advice engagement letter. The role of the Shariah Advisor is outlined in a separate Shariah Advisor Role Description document.

Overheads

PWF will not use ANY Zakah donations for overheads. Overheads will be funded from gift aid, other income, riba and lillah donations.

PWF will use maximum 5% of Zakah donations towards specific Overhead costs. This is because the charity considers itself as a ‘Zakah-administor’ i.e. category 3 of the 8 Zakah recipients. However, it will restrict itself to using maximum 5% of Zakah funds received. These specific overhead costs are salaries of those involved in the Zakat distribution, and support or governance costs required to distribute the costs of the Zakah, any banking & payment processes costs. It will not be used for costs such as fund-raising.

PWF will use maximum 5% of Zakah donations towards general Overhead costs. This is because the charity considers itself as a ‘Zakah-administor’ i.e. category 3 of the 8 Zakah recipients. However, it will restrict itself to using maximum 5% of Zakah funds received.

Board of Trustees

The Board of Trustees will be responsible for approving this Zakah policy on an annual basis. PWF is committed to upskilling current and prospective trustees on all matters of Zakah policy and procedure to provide confidence to donors around competent governance and oversight processes.

 

 

Transparency

PWF is committed to transparency by making its Zakah policy available online on its website. Consumer friendly FAQs will also be on the website to communicate how the policy is translated into practice.

Education

PWF is committed to increasing Zakah education amongst its personnel, key management, volunteers, trustees and donors by generating and/or linking to Islamic teachings on its website and/or holding webinars/seminars/training sessions.
